1. Acceptance of Terms
By accessing or using Artvio ("Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Eligibility
You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
3. Account Registration
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. We reserve the right to suspend or terminate accounts that violate these terms.
4. Credits & Payments
Our Service operates on a credit-based system. Credits are non-refundable and non-transferable unless otherwise specified. Prices are subject to change with notice. All payments are processed securely through Stripe. Subscription plans auto-renew unless cancelled before the renewal date. You are responsible for all charges incurred under your account.
5. Acceptable Use
You agree to use the Service only for lawful purposes. You may not use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, hateful, or discriminatory. You may not attempt to gain unauthorized access to the Service, other accounts, or computer systems. You may not use the Service to infringe on intellectual property rights of others.
6. Prohibited Content
You may not use the Service to generate: (a) content depicting minors in inappropriate situations; (b) non-consensual intimate imagery; (c) content promoting violence, terrorism, or illegal activities; (d) content that infringes copyrights, trademarks, or other intellectual property; (e) deepfakes or deceptive content intended to mislead; (f) content that violates any applicable laws or regulations. We reserve the right to remove any content and terminate accounts that violate these restrictions.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Artvio and protected by international copyright, trademark, and other intellectual property laws. Images generated using our Service are subject to our License Agreement. You retain rights to your prompts, but grant us a license to use them for service improvement.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free. AI-generated content may not always meet your expectations. We are not responsible for the accuracy, quality, or appropriateness of generated content. You use the Service at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, Artvio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which should survive termination shall survive.
